1. 關於我們與本條款
歡迎使用 IELTS Monster（「本服務」）。本服務由 CC English Limited（思悅教育有限公司，商業登記編號 76262632） （「本公司」、「我們」）營運。你註冊帳戶、存取或使用本服務，即表示你已閱讀、明白並同意受本條款約束。 如你不同意本條款任何部分，請勿使用本服務。
重要聲明：IELTS 是 British Council、IDP: IELTS Australia 及 Cambridge University Press & Assessment 的註冊商標。本服務為獨立備考練習平台，與上述機構並無任何從屬、認可或合作關係。本服務提供的任何分數或評級僅為練習參考估算， 不代表亦不保證你在正式考試中的成績。
2. 服務內容
本服務提供 IELTS 備考工具，包括（因應方案不同）：模擬試卷與計時測驗、題庫刷題與錯題簿（間隔重溫）、 AI 作文批改、AI 學習教練對話、AI 個人化讀書計劃、學習進度追蹤，以及真人課程／導師轉介。
我們會持續改進服務，可能不時新增、修改或移除個別功能。若變動實質削減你已付費方案的核心功能， 我們會提前以合理方式通知。
3. 帳戶與資格
- 你必須提供準確、完整的註冊資料（電郵及密碼，或經 Google 等第三方帳戶登入），並於資料變更時更新。
- 未滿 18 歲的使用者，須先取得家長或監護人同意方可註冊及使用本服務（包括 AI 功能）。 家長或監護人須同意本條款並為該未成年人的使用負責。
- 帳戶僅供你本人使用，不得共用、轉讓或出售。你須妥善保管密碼， 並對帳戶下的一切活動負責；如發現未經授權使用，請立即通知我們。
4. 方案、收費與付款
4.1 方案：現行方案及價格以定價頁面顯示為準，目前為：

價格以美元（USD）結算；你的發卡銀行或會另收貨幣轉換或跨境交易費用。 網課學生方案由導師／管理員直接開通，不設自助購買。
4.2 計費模式：
- Pro 月費為月度訂閱：每月自動於你的原付款方式扣款，直至你取消 （取消方式見第 5.1 條）。取消後不會再扣下一期，已付周期可繼續使用至周期完結。
- 考季通為一次性預繳：付款一次可用 3 個月，不會自動扣款續期。 期滿後帳戶回復至 Free 方案，已產生的學習紀錄保留。
- 終身使用為一次性付款：付款一次即可持續使用付費功能，不設到期日，亦不會自動扣款。「終身」指本服務的營運期間； 如本服務全面終止，我們會依第 10 條處理。
4.3 疊加購買：若你在現有考季通未屆滿時再次購買考季通，新購期限將由現有到期日起順延，不會由付款日重新計算。
4.4 付款方式與開通：付款於 Stripe Checkout 託管頁面完成（支援信用卡及 Apple Pay，實際可用方式以付款頁面顯示為準），你的卡號等支付憑證由 Stripe 直接處理，不會經過或儲存於我們的伺服器。 付款成功後，方案一般會即時開通；如超過一個工作天仍未開通，請聯絡我們（見第 14 條）， 我們會盡快補回開通，或按你要求取消該次購買並全額退款。
4.5 價格調整：我們可調整方案價格；調整不影響你已付費的現有期限。 訂閱方案如有價格調整，我們會於調整生效前最少 30 天通知你，你可於生效前取消。
5. 取消與退款政策
5.1 取消：
- Pro 月費（訂閱）：你可隨時取消，不設最短訂閱期或取消手續費。 請於下一個扣款日前聯絡我們（見第 14 條），我們會於一個工作天內確認取消。 取消於當前計費周期完結時生效：其後不會再扣款，已付周期可繼續使用至期末。
- 考季通：一次性付款，不會自動續費，毋須辦理任何取消手續； 期滿自動回復至 Free 方案。
- 終身使用：一次性付款，不會自動續費，毋須辦理任何取消手續。
- 未開通的購買：如你已完成付款但方案未有開通（見第 4.4 條）， 你可選擇由我們補回開通，或取消該次購買並獲全額退款。
5.2 七天冷靜期：你可於付款後 7 天內聯絡我們（見第 14 條） 取消購買並獲全額退款，條件是你於該段期間未實質使用付費功能（以系統紀錄為準，例如：未提交 AI 作文批改、未開始任何付費模擬試卷）。 冷靜期適用於考季通、Pro 月費及終身使用的首次付款（Pro 月費的續費扣款不適用）， 每名用戶以一次為限。
5.3 其他退款情況：付費方案屬數碼服務，於付款確認後開通並可全面使用。 除第 5.2 條冷靜期外，已開通的付費期恕不退款，除非：
- 因我們的技術故障導致你於連續 7 天或以上實質無法使用核心付費功能；
- 重複扣款或金額錯誤；
- 香港法律規定不可排除的退款責任。
如符合上述情況，請於問題發生後 30 天內聯絡我們（見第 14 條），核實後我們會按比例退回未使用期限的費用， 或以延長使用期補償（由你選擇）。
6. AI 功能與公平使用
- AI 批改、AI 教練等功能由第三方大型語言模型（現為 Google Gemini）驅動。AI 產出可能不準確、不完整或帶有偏差，僅供學習參考，不構成任何保證或專業意見。 AI 估算分數與正式 IELTS 成績可能存在差距。
- 標示為「無限」的 AI 功能受公平使用原則約束：系統設有每日用量上限， 以防止濫用並確保所有用戶的服務品質。正常個人備考使用不會觸及上限；達到上限時， 相關功能將暫停至次日恢復。
- 你不得利用 AI 功能生成違法、侵權、仇恨或色情內容，不得嘗試繞過用量限制、 提取系統提示或以自動化方式呼叫 AI 功能。
7. 可接受使用
你同意不會：
- 以爬蟲、指令碼或其他自動化方式存取本服務或抓取內容；
- 複製、下載、翻印、轉售或向第三方分發本服務的題庫、試卷、範文、教材或其他內容 （個人備考的合理筆記除外）；
- 逆向工程、反編譯或試圖取得本服務原始碼；
- 規避付費牆、用量限制或安全機制，或試圖未經授權存取他人資料；
- 上傳病毒、惡意程式，或作出干擾服務正常運作的行為；
- 冒充他人或虛報與任何人或機構的關係。
8. 你提交的內容
你在本服務提交的內容（包括作文、與 AI 教練的對話、個人學習目標等，「用戶內容」）：
- 你保證你有權提交該等內容，且不侵犯他人權利；
- 你授予我們一項非專屬、免版稅的許可，以營運本服務所需的範圍使用該等內容 （包括儲存、傳送予 AI 服務商作批改與回應、供你指定的真人導師批閱， 以及以去識別化及匯總方式改進服務品質）；
- 用戶內容的所有權仍屬於你；
- 我們可移除違反本條款的用戶內容，毋須事先通知。
9. 知識產權
本服務的一切內容（題庫、試卷、教材、評分準則、介面設計、程式碼、商標及品牌元素） 均屬本公司或其授權人所有，受版權及其他知識產權法律保護。除本條款明文允許外， 未經我們書面同意不得使用。
10. 終止
- 你可隨時停用帳戶；如需刪除帳戶及個人資料，請依私隱政策所述聯絡我們。
- 如你違反本條款（包括共用帳戶、抓取題庫、濫用 AI 功能），我們可暫停或終止你的帳戶而毋須退款； 情節輕微者我們會先行警告。
- 我們全面終止本服務時：我們會於不少於 30 日前以電郵通知你， 並在通知期內讓你匯出學習紀錄。屆時仍在有效期內的考季通及 Pro 月費， 按未使用日數比例退款；終身使用方案如購買未滿 24 個月， 按 24 個月為基準就未使用月數比例退款。
- 條款中依其性質應於終止後續存的條文（包括知識產權、免責聲明、責任限制、管轄法律） 於終止後繼續有效。
11. 免責聲明
在香港法律允許的最大範圍內：本服務按「現狀」及「現有」基礎提供，我們不就服務不中斷、無錯誤、 或使用本服務能達致任何特定考試成績作出保證。本條款不影響你依《服務提供（隱含條款）條例》及 《管制免責條款條例》等香港法律享有的不可排除權利。
12. 責任限制
在香港法律允許的最大範圍內，我們就本服務所生一切申索的總責任，以你於申索事由發生前 12 個月內向我們實際支付的費用總額為上限。我們不對間接、附帶、特殊或後果性損失 （包括考試成績、升學或移民申請結果）承擔責任。本條不排除因我們疏忽引致的人身傷亡責任或 任何依法不可排除的責任。
13. 條款修訂、管轄法律與其他
- 我們可不時修訂本條款。重大修訂將於生效前至少 30 天透過站內通知或電郵通知你； 修訂生效後繼續使用即視為接受。
- 本條款受香港特別行政區法律管轄，雙方受香港法院的專屬司法管轄權管轄。
- 本條款任何條文被裁定無效，不影響其餘條文的效力。我們一時不行使任何權利，不構成放棄該權利。
- 本條款備有中英文版本，如有歧義，概以英文版為準。

1. About Us and These Terms
Welcome to IELTS Monster (the “Service”), operated by CC English Limited (思悅教育有限公司, Business Registration No. 76262632) (“the Company”, “we”, “us”). By creating an account, accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use the Service.
Important notice: IELTS is a registered trademark of the British Council, IDP: IELTS Australia and Cambridge University Press & Assessment. The Service is an independent test-preparation platform and is not affiliated with, endorsed or approved by any of those organisations. Any score or band produced by the Service is a practice estimate only and does not represent or guarantee your result in any official examination.
2. The Service
The Service provides IELTS preparation tools, which (depending on your plan) include: mock papers and timed tests, question-bank drills with a spaced-repetition mistake book, AI essay marking, an AI study coach (chat), AI-personalised study plans, progress tracking, and referral to human courses/tutors.
We continuously improve the Service and may add, modify or remove features from time to time. If a change materially reduces the core functionality of a plan you have paid for, we will give you reasonable advance notice.
3. Accounts and Eligibility
- You must provide accurate and complete registration information (email and password, or sign-in via a third-party account such as Google) and keep it up to date.
- If you are under 18, you may only register and use the Service (including AI features) with the consent of a parent or guardian, who must agree to these Terms and is responsible for your use.
- Your account is personal to you and must not be shared, transferred or sold. You are responsible for safeguarding your password and for all activity under your account. Notify us immediately of any unauthorised use.
4. Plans, Fees and Payment
4.1 Plans. Current plans and prices are as displayed on the pricing page, presently:

Prices are charged in US dollars (USD); your card issuer may apply currency-conversion or cross-border fees. The course-student plan is activated directly by a teacher/administrator and is not sold via self-service checkout.
4.2 Billing models.
- Pro Monthly is a monthly subscription: your original payment method is charged automatically each month until you cancel (see clause 5.1 for how). After cancellation no further charge arises, and you keep access for the period already paid.
- Season Pass is a one-off prepayment: pay once for 3 months of access; it does not auto-renew or auto-charge. When it expires, your account reverts to the Free plan and your study records are retained.
- Lifetime is a one-off payment: pay once and keep access to the paid features with no expiry date and no further charge. “Lifetime” means for as long as we operate the Service; if we discontinue it entirely, clause 10 applies.
4.3 Stacked purchases. If you buy another Season Pass before your current one expires, the new period is appended to your existing expiry date, not restarted from the payment date.
4.4 Payment and activation. Payment is completed on the Stripe Checkout hosted page (card and Apple Pay — the methods actually available are as shown on the payment page). Your card number and payment credentials are handled directly by Stripe and never pass through or get stored on our servers. Your plan is normally activated immediately after successful payment; if it is not activated within one business day, contact us (clause 14) and we will activate it promptly or, at your request, cancel the purchase for a full refund.
4.5 Price changes. We may change plan prices. Changes do not affect any period you have already paid for. For subscription plans we will give you at least 30 days’ notice before a price change takes effect, and you may cancel before it does.
5. Cancellation and Refund Policy
5.1 Cancellation.
- Pro Monthly (subscription): you may cancel at any time, with no minimum term and no cancellation fee. Contact us (clause 14) before your next billing date; we will confirm the cancellation within one business day. Cancellation takes effect at the end of the current billing period: no further charge arises, and you keep access until the period ends.
- Season Pass: a one-time payment that does not auto-renew, so there is nothing to cancel; your account reverts to the Free plan automatically when it expires.
- Lifetime: a one-time payment that does not auto-renew, so there is nothing to cancel.
- Purchases not activated: if you have paid but your plan has not been activated (see clause 4.4), you may choose between us activating it promptly and cancelling the purchase for a full refund.
5.2 7-day cooling-off. Within 7 days of payment you may contact us (clause 14) to cancel the purchase for a full refund, provided you have not made substantial use of the paid features in that time (as shown by system records — for example, no AI essay submitted for marking and no paid mock test started). The cooling-off applies to Season Pass and Lifetime purchases and to the first payment of a Pro Monthly subscription (not to renewal charges), and is limited to one refund per user.
5.3 Other refunds. Paid plans are digital services activated upon payment confirmation and fully usable thereafter. Apart from clause 5.2, activated paid periods are non-refundable, except where:
- a technical failure on our side has made the core paid features substantially unusable for 7 or more consecutive days;
- you were charged in duplicate or in an incorrect amount; or
- a refund is required by Hong Kong law and cannot be excluded.
In those cases, contact us (clause 14) within 30 days of the issue. Upon verification we will refund the unused portion of your period pro rata, or extend your access period by way of compensation, at your choice.
6. AI Features and Fair Use
- AI marking, the AI coach and similar features are powered by third-party large language models (currently Google Gemini). AI output may be inaccurate, incomplete or biased; it is provided for study reference only and is not a guarantee or professional advice. AI-estimated bands may differ from official IELTS results.
- Features described as “unlimited” are subject to a fair-use policy: daily usage caps apply to prevent abuse and protect service quality for all users. Normal personal exam preparation will not reach the caps; if a cap is reached, the feature pauses until the next day.
- You must not use AI features to generate unlawful, infringing, hateful or sexually explicit content, nor attempt to bypass usage limits, extract system prompts, or invoke AI features by automated means.
7. Acceptable Use
You agree not to:
- access the Service or extract content by crawler, script or other automated means;
- copy, download, reproduce, resell or distribute to any third party the Service’s question bank, papers, model answers, teaching materials or other content (reasonable personal study notes excepted);
- reverse-engineer, decompile or attempt to obtain the Service’s source code;
- circumvent the paywall, usage limits or security mechanisms, or attempt unauthorised access to other users’ data;
- upload viruses or malicious code, or otherwise interfere with the normal operation of the Service; or
- impersonate any person or misrepresent your affiliation with any person or organisation.
8. Your Content
For content you submit to the Service (including essays, conversations with the AI coach and personal study goals — “User Content”):
- you warrant that you have the right to submit it and that it does not infringe the rights of others;
- you grant us a non-exclusive, royalty-free licence to use it to the extent needed to operate the Service (including storing it, transmitting it to our AI provider for marking and responses, making it available to a human tutor you designate, and using it in de-identified, aggregated form to improve service quality);
- you retain ownership of your User Content; and
- we may remove User Content that violates these Terms without prior notice.
9. Intellectual Property
All content of the Service (question bank, papers, teaching materials, marking rubrics, interface design, code, trademarks and brand elements) belongs to the Company or its licensors and is protected by copyright and other intellectual-property laws. It may not be used except as expressly permitted by these Terms or with our written consent.
10. Termination
- You may stop using your account at any time; to delete your account and personal data, contact us as described in the Privacy Policy.
- If you breach these Terms (including account sharing, scraping the question bank, or abusing AI features), we may suspend or terminate your account without refund; for minor breaches we will normally warn you first.
- If we discontinue the Service entirely: we will give you at least 30 days’ notice by email and let you export your study records during that period. Season Pass and Pro Monthly periods still running at that point are refunded pro rata for the unused days; a Lifetime plan bought less than 24 months earlier is refunded pro rata for the unused months against a 24-month reference period.
- Provisions which by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and governing law) survive termination.
11. Disclaimer
To the maximum extent permitted by Hong Kong law, the Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted or error-free, or that use of the Service will achieve any particular examination result. Nothing in these Terms affects rights you have under the Supply of Services (Implied Terms) Ordinance, the Control of Exemption Clauses Ordinance or other Hong Kong law that cannot be excluded.
12. Limitation of Liability
To the maximum extent permitted by Hong Kong law, our total liability for all claims arising out of or in connection with the Service is capped at the total fees you actually paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential loss (including examination results or the outcome of any admission or migration application). Nothing in this clause excludes liability for death or personal injury caused by our negligence, or any liability that cannot be excluded by law.
13. Changes, Governing Law and General
- We may revise these Terms from time to time. For material changes we will give at least 30 days’ notice via in-app notification or email before they take effect; continued use after the effective date constitutes acceptance.
- These Terms are governed by the laws of the Hong Kong Special Administrative Region, and the parties submit to the exclusive jurisdiction of the Hong Kong courts.
- If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of it.
- These Terms are published in Chinese and English. In case of inconsistency, the English version prevails.
